Terms of Service for the CreditBuddy platform

Terms of Service

These terms govern use of CreditBuddy as a software platform for lenders. They are written to reflect CreditBuddy's role as a product provider, not a lender, intermediary, or financial services business.

Important positioning

CreditBuddy provides software only. CreditBuddy is not a credit provider, not a financial services provider, does not lend money, and does not act as a credit intermediary between lenders and borrowers.

1. About CreditBuddy

CreditBuddy is a software platform designed to help lenders manage customer records, loans, repayment schedules, collections activity, and related operational workflows.

CreditBuddy is not a credit provider, not a financial services provider, and not a credit intermediary. CreditBuddy does not lend money, arrange loans on behalf of lenders, or make lending decisions for lenders.

Each lender using CreditBuddy remains independently responsible for the loans it offers, the terms it sets, the collection steps it takes, and the legal and regulatory framework that applies to its business.

2. Who The Service Is For

The service is intended for lenders and lending businesses that need software to run day-to-day lending operations more clearly and efficiently.

You may only use CreditBuddy if you are authorised to act for the lender account you create and if you can lawfully enter into these terms.

The platform is not intended as consumer credit advice, financial product advice, or a marketplace guarantee for borrowers or lenders.

3. Accounts And Access

You are responsible for keeping login credentials secure, controlling access to your workspace, and ensuring that only authorised team members use the account.

You must ensure that the information you provide to create and maintain your account is accurate and kept reasonably up to date.

You are responsible for all activity that takes place under your account, including data entered by your staff, contractors, or other authorised users.

4. Acceptable Use

You may use CreditBuddy only for lawful business purposes connected to your lending operations.

You may not use the service to upload unlawful, misleading, defamatory, infringing, or malicious content, interfere with the service, attempt unauthorised access, reverse engineer the platform except where the law clearly permits it, or use the service in a way that could harm other users or the platform.

You may not use CreditBuddy to impersonate another person or business, misrepresent your lending activities, or process personal information without a lawful basis.

5. Your Lending And Compliance Responsibilities

You are solely responsible for collecting borrower information lawfully, obtaining any required consents or notices, keeping appropriate records, and ensuring that your lending, affordability practices, collections conduct, and customer communications comply with applicable law.

You are responsible for determining whether your business must register with any regulator or comply with any sector-specific rules, including rules that may apply to credit provision, debt collection, consumer protection, record keeping, or marketing.

CreditBuddy provides software tools only. Any reports, reminders, fields, templates, or workflow suggestions made available through the platform are operational aids and do not constitute legal, regulatory, compliance, or financial advice.

6. Fees, Subscriptions, And Billing

CreditBuddy may offer free access, trial access, paid subscriptions, usage-based features, or other commercial plans from time to time.

Where paid plans apply, pricing, billing intervals, payment methods, renewal rules, and any applicable taxes will be described in the relevant sign-up flow, account settings, quote, or commercial communication.

If a payment processor is used, payments will be handled through that processor on its terms. We may suspend access to paid features for overdue or failed payments, subject to any notice we choose to provide.

We may update pricing or plan features prospectively on reasonable notice. Any beta-era billing arrangements may be replaced or refined as the commercial offering matures.

7. Data Processing And POPIA Positioning

For personal information that you upload or capture in CreditBuddy for your lending activities, the lender is the responsible party and CreditBuddy acts as an operator processing personal information on the lender’s behalf.

You instruct CreditBuddy to host, organise, store, display, and otherwise process that information only as needed to provide the software service and related support, security, maintenance, and product improvement activities that are compatible with that service.

You remain responsible for identifying your lawful basis for processing, providing any required privacy notices, handling data subject requests where required, assessing whether any further operator agreements are needed for your circumstances, and deciding what information should be entered into the platform.

CreditBuddy will take reasonable steps appropriate to a beta-stage SaaS platform to protect personal information in its role as operator, but you acknowledge that no system can guarantee absolute security or uninterrupted availability.

Where a separate privacy notice, support policy, or more detailed data processing addendum is later published, those documents will supplement these terms to the extent stated in them.

8. Service Availability And No Warranty

CreditBuddy is provided on an as available basis. We may change, improve, suspend, or discontinue parts of the service at any time, particularly during beta.

We do not warrant that the service will always be uninterrupted, error-free, fully secure, or suitable for every lending workflow or compliance environment.

You are responsible for reviewing your records, reconciling your lending data, and using independent judgment before relying on the platform in operational or legal decisions.

9. Limitation Of Liability

To the maximum extent permitted by law, CreditBuddy will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profits, revenue, business opportunity, goodwill, or data.

CreditBuddy will also not be responsible for losses arising from your lending decisions, loan defaults, borrower conduct, third-party payment services, regulatory non-compliance, incorrect data entered by your organisation, or your failure to keep backup records or internal controls.

Where the law permits a limitation of direct liability, CreditBuddy’s aggregate liability in connection with the service will be limited to the amounts actually paid by you for the service in the three months before the event giving rise to the claim, or if no fees were paid, a reasonable nominal amount.

10. Suspension And Termination

You may stop using the service at any time.

We may suspend or terminate access if we reasonably believe you have breached these terms, used the service unlawfully, created material security or operational risk, or failed to pay applicable fees.

We may also suspend or limit access where reasonably necessary for maintenance, security, legal compliance, or service protection. Clauses that by nature should continue after termination, including clauses on liability, compliance responsibility, and data processing positioning, will continue to apply.

11. Updates To These Terms

We may update these terms from time to time as the product, pricing model, legal documentation, or operating model develops.

If we make a material change, we may publish the updated terms on the site or notify users through the service. Continued use of CreditBuddy after an updated version takes effect will mean you accept the revised terms.

If no dedicated legal contact is published yet, account holders may use the standard product support contact currently provided through the platform or onboarding communications.
